Who can file a wrongful death claim in Arizona?

In Arizona, wrongful death claims can only be filed by the surviving spouse, children, parents, or the personal representative of the deceased person’s estate. If the deceased was a child, parents or legal guardians have the right to file.

Compensation may include medical expenses prior to death, funeral and burial costs, loss of income and financial support, loss of companionship, pain and suffering experienced by surviving family members, and in some cases, punitive damages.

Medical bills become part of the deceased’s estate. In most cases, the estate is responsible for paying these bills using estate assets before distributing to beneficiaries. However, family members are not personally liable unless they co-sign for medical care.

Yes. In Arizona, you generally have two years from the date of death to file a wrongful death lawsuit.
