With that traffic comes a real risk of serious injury. Boating accidents can be just as devastating as car crashes, but the legal landscape is surprisingly different. Why Boating Accidents Are Harder to Investigate Than Car Accidents 

When two cars collide, the scene more or less preserves itself. Vehicles stay put, skid marks remain on the pavement, and police can arrive and document everything relatively quickly. On the water, none of that applies. 

Boats keep moving after a collision. Currents, wakes, and the actions of other boaters can scatter evidence almost immediately. First responders take longer to reach the scene because getting law enforcement onto the water simply takes more time than a roadside response. By the time anyone starts piecing together what happened, a lot of the physical evidence may already be gone. 

That means boating accident cases are built largely on witness statements and damage assessments on the vessels themselves. This makes having an experienced attorney in your corner especially important from the very beginning. 

Arizona Has Adopted Admiralty Laws — and They Matter 

What many people don’t realize is that Arizona has adopted a body of rules known as admiralty laws — regulations that originated in coastal states to govern how boats are operated on the ocean. Arizona has incorporated many of these rules into state law, and they apply to every boat and watercraft, including jet skis, operating on Arizona lakes. 

These laws cover things like the required direction of travel, right-of-way rules when two vessels are approaching each other, required lighting, signage, and more. After a collision, these rules become the framework for determining who was at fault. Attorneys look at the specific circumstances of the accident, compare them against these laws, and assess whether one or both operators were negligent. It’s a more specialized analysis than most people expect. 

The Insurance Question — and Why It’s Complicated 

Here’s where things get particularly tricky. In Arizona, drivers are required by law to carry auto insurance. No such requirement exists for boaters. That means a significant number of people out on the water are completely uninsured — and if one of them injures you, finding a source of compensation can be a real challenge. 

But the picture isn’t always as bleak as it seems, for a couple of reasons. 

First, boat owners who have homeowner’s insurance may already have coverage they don’t even know about. If a homeowner’s policy doesn’t contain a specific exclusion for watercraft, it very likely covers the boat. Many people are genuinely unaware this applies to them. 

Second, in situations involving organized events or gatherings, such as a company party on the lake or a corporate-sponsored outing, there may be coverage available through a business’s general liability policy. This is an area where having a firm that knows how to search for coverage can make an enormous difference. It’s not uncommon for insurance to exist in these situations that other attorneys simply don’t think to look for. 

What to Do If You’re Injured on the Water 

The steps you take immediately after a boating accident can significantly affect your ability to recover compensation. Here’s what matters most: 

Call 911. Boating accidents in Arizona are typically investigated by the county sheriff. Getting law enforcement on the scene (and on the record) is critical. 

Get a copy of the sheriff’s report. Once the investigation is complete, obtain the report and review any conclusions the sheriff made about fault or contributing factors. This document can be a key piece of your claim. 

Don’t assume there’s no insurance. Before concluding that the other party has no coverage, have an attorney check homeowner’s policies, watercraft policies, and any applicable business or event liability coverage. Coverage often exists where it isn’t expected.
